Electronic Notice Legislation Signed into Law

On April 29, Governor Ron DeSantis signed one of the association’s top legislative priorities, HB 615 – Electronic Delivery of Notices Between Landlords and Tenants, into law. Beginning July 1, 2025, this law, soon to be codified as Florida Statute 83.5051, will permit landlords and tenants to send and receive notices electronically, provided certain conditions are met.

Important Update for Florida Click & Lease Users:
On June 11, 2025, the National Apartment Association (NAA) announced that an electronic notice addendum will be available in the Click & Lease portal starting June 25, 2025.


About HB 615

Previously, Florida’s Landlord-Tenant Act (Chapter 83, F.S.) required that all legal notices be delivered in writing by mail or hand-delivered to the resident’s unit. While property managers already use emails, texts, and online portals to communicate with residents, legal notices had to follow outdated delivery methods.

HB 615 brings the law up to date by allowing both parties to opt in to electronic delivery of legal notices, making the process more secure, efficient, and private.


Why It Matters

Traditionally, notices sent by mail can be delayed or go missing. As a result, landlords often resort to hand-delivery or posting notices on residents’ doors, an approach that can raise privacy concerns, pose safety risks, and cause distress for residents.

This new law, passed as CS/CS/CS/HB 615 (Rep. Esposito) / SB 1164 (Sen. Leek), provides a modern, optional alternative that enhances communication while respecting resident privacy.
