Since mid-2017, there has been an uptick in the number of lawsuits filed against companies operating consumer-facing websites under the Americans with Disabilities Act (ADA), alleging that the websites do not provide appropriate accommodations for those with vision or hearing disabilities. More recently, we are seeing an increase in website accessibility lawsuits asserting claims under the federal Fair Housing Act (FHA), in addition to the claims asserted under the ADA. The FHA claims generally allege that the lack of accessible housing websites exists as a barrier to equal housing opportunities. While website compliance under the ADA is a growing issue for those in the apartment management industry, these lawsuits also target many other industries such as financial services, hospitality, retail, energy, fitness and healthcare, to name a few.
